POLICIES GOVERNING THE USE OF ARCHIVAL AND MANUSCRIPT COLLECTIONS SPECIAL COLLECTIONS RESEARCH CENTER
THE UNIVERSITY OF CHICAGO LIBRARY
The University of Chicago Library acquires, preserves, and makes available archival and manuscript collections for the use of University faculty, students, alumni, and staff, and visiting scholars, researchers, and members of the public. The following policies govern the consultation, copying, and publication of materials in these collections.
CONSULTATION 1. Every researcher requesting access to an archival or manuscript collection must complete and sign the Library's archival and manuscript application form. Permission for access is granted on a case-by-case basis and subject to restrictions defined by federal and state law, University of Chicago administrative policies, gift and bequest agreements, and Library preservation standards. 2. Archival and manuscript materials may be consulted by researchers only in designated Library reading room areas. Researchers must comply with stated policies for the use of rare, archival, and manuscript materials in the reading room. COPYING 3. Requests for copies of archival and manuscript materials must be made using a Library application form accompanied by a signed agreement that no document or substantial portion of a document in excess of fair use as defined by copyright law will be published or further reproduced without the permission of the copyright holder and the Library. 4. Reproductions of archival and manuscript materials are intended solely for the use of the individual submitting the request. No further copy of the reproduction may be made without the express permission of the copyright holder and the Library. PUBLICATION 5. Permission to consult archival and manuscript material or to obtain a copy of such material does not convey the right to publish or to reproduce the material in any form. Publication privileges are secured only with the joint permission of the holder of the literary rights and the Library as owner of the material. The holder of the literary rights may be the writer, the writer's heirs or assigns, the writer's literary executor or other designated legal representative, or the University of Chicago. 6. When permission to publish is granted, the applicant agrees to indicate in all relevant citations, bibliographies, and credits within the published work that the original archival and manuscript material is held by the University of Chicago Library. 7. The applicant assumes full and complete responsibility for and shall defend and indemnify the University of Chicago against any claim, demand, cost or expense related to any infringement of any literary rights, copyrights, or other rights that may result from use or publication of the archival and manuscript material held by the University of Chicago Library.
RESEARCHER'S AGREEMENT In accordance with the University Library's Policies Governing the Use of Archival and Manuscript Collections, which I have read, I make application for the use of the collection specified above. I agree to publish no portion of this material without the written permission of the writer, or his/her heirs or assigns, and the University of Chicago Library. I ALSO ASSUME SOLE RESPONSIBILITY FOR AND AGREE TO DEFEND AND INDEMNIFY THE UNIVERSITY OF CHICAGO AND ITS BOARD OF TRUSTEES, OFFICERS, EMPLOYERS AND AGENTS FOR ALL CLAIMS DEMANDS, COSTS OR EXPENSES (INCLUDING ATTORNEYS' FEES) RESULTING FROM ANY INFRINGEMENT OF THE LITERARY RIGHTS, COPYRIGHTS, OR OTHER RIGHTS PERTAINING TO THIS MATERIAL.
