Abstract:

Hans Zeisel (1905-1992) was a scholar of law and social science at the University of Chicago Law School. He was an expert on juries, capital punishment, and political and market survey techniques. He served on the faculty of the University of Chicago Law School from 1953 until 1974. There, as one of the leaders of the well-known Jury Project, Zeisel strove to apply social research methodology to the field of law. This collection includes a small amount of personal ephemera and teaching materials, but is primarily comprised of correspondence; materials from his work as a litigation consultant; research files concerning law, social science, and a variety of other topics; materials related to the Jury Project and other studies he undertook; his own writings and writings by others; and audio and visual recordings. Materials date between 1925 and 1992, with the bulk dating between 1950 and 1992. The papers document the wide variety of Zeisel's academic interests and his scholarly and professional efforts to improve the administration of justice.

Access

This collection is open for research with the exception of material in Series XI. This series contains restricted financial and personnel information; student material; correspondence; and consulting materials. The financial and personnel information is restricted for fifty years from date of record creation, and will be fully open in 2042. The rest of the materials in Series XI are restricted for eighty years from date of record creation and will be fully open in 2072.

Restrictions on Use

Series IX, Audiovisual, does not include an access copy for the audio and video recordings. Researchers will need to consult with staff before requesting these items.

Biographical Note

Hans Zeisel was born in Czechoslovakia in 1905 and raised in Vienna. He attended the University of Vienna, earning a law degree in 1927 and a doctorate in political science in 1928. Zeisel worked closely with prominent sociologist Paul F. Lazarsfeld. Together with Lazarsfeld's wife, Marie Jahoda, they published the influential work Die Arbeitslosen von Marienthal: Ein soziographischer Versuch über die Wirkungen langdauernder Arbeitslosigkeit in 1933. (An English edition, Marienthal: The Sociography of an Unemployed Community, was published in 1971.)

In 1938 he married Eva Stricker, an internationally-known ceramics designer. They had two children: Jean Richards, an actress, and John Zeisel, an architect. John Zeisel taught at Harvard's Graduate School of Design and started a firm that conducted social science research for architects in order to help them determine the special needs of their clients.

Following the Anschluss in 1938, Zeisel left Austria for the United States where he worked in the burgeoning field of market research, holding positions at advertising agency McCann-Erickson and the Tea Council. During this time he also taught sociology at Columbia and Rutgers Universities. In 1947 Zeisel published Say It With Figures, a text published in six editions and seven languages due to its clear explanation of the methodology of survey data.

In 1953 he was appointed to the faculty of the University of Chicago Law School as part of Dean Edward Levi's initiative to bolster the study of social science and the law. There he worked closely with Professor Harry Kalven, Jr., another leader of the Law School's Jury Project. The Jury Project, an empirical study of the American jury system, led to the publication of Delay in the Court (1959) and The American Jury (1966). The former text concerned the role of the jury in court congestion that plagued civil litigation and the latter concerned the jury system in criminal trials. A third volume, a text on the civil jury entitled The American Civil Jury, was never published, but drafts and notes are included in this collection.

After Kalven's death in 1974, Zeisel collaborated frequently with psychologist Shari Seidman Diamond. The two co-authored numerous articles concerning the effectiveness of the justice system. In 1983 Zeisel authored The Limits of Law Enforcement, which argued that the best way to deter criminal activity was to improve the social environment (particularly youth education) rather than bolstering law enforcement efforts.

Zeisel frequently served as a litigation consultant on issues pertaining to survey methodology, particularly change-of-venue matters and trademark confusion lawsuits. Most famously, he aided Ford Motor Company in their litigation following the Pinto fuel tank scandal. In addition to many commercial companies, Zeisel served as a consultant for the U.S. War Department, the U.S. Department of Justice, the Rand Corporation, and the American Bar Association throughout his career. A fervent opponent of the death penalty, he also consulted on numerous capital punishment cases, seeking to demonstrate both that the death penalty did not function as a deterrent to crime and that it was often applied in a racially discriminatory manner.

Zeisel was a fellow of the American Academy of Arts and Sciences, the American Statistical Association, and the American Association for the Advancement of Science. He was a member of the governing board of the Bulletin of Atomic Scientists. In 1967 Zeisel received the Award for Exceptionally Distinguished Achievement from the American Association for Public Opinion Research, the organization's highest honor. In 1992 Zeisel was the recipient of the Paul F. Lazarsfeld Award for his contributions to the field of quantitative social research.

Zeisel died in 1992 in Chicago. His final book, Prove It With Figures: Empirical Methods in Law and Litigation, was published posthumously in 1997 by co-author David Kaye.

I. Personal: Contains personal and biographical materials concerning Zeisel's career and family.

II. Correspondence: Contains correspondence between Zeisel and his colleagues, both academic and professional. Correspondents of note (highlighted in the inventory) include actress Katharine Hepburn, First Lady Eleanor Roosevelt, activist Coretta Scott King, and several Supreme Court justices, among others. Some correspondence is written in German.

III. Consulting: Includes correspondence, surveys, reports, court documents, and notes related to Zeisel's work as a litigation consultant. He advised companies and their legal counsel on matters concerning trademark infringement and confusion, jury selection, and general survey and sampling techniques. It also includes Zeisel's evaluations of grant proposals and articles for institutions like the National Science Foundation. Consulting files related to specific litigation and not part of the public record are located in Series X: Restricted.

IV. Teaching: Contains course materials such as syllabi, exams, and readings, related to his courses on social science research in the law and capital punishment.

V. Research: Consists of subject files related to Zeisel's legal and social science research as well as his personal interests. These files include articles, memoranda, notes, and other documents gathered in the course of his research. His general research files include topics as wide-ranging as literature, science, and political conditions in Europe and Russia.

VI. Projects and Studies: Contains documents such as questionnaires, research proposals, correspondence, and reports related to Zeisel's many projects applying social science to the law. The bulk of the series concerns the University of Chicago Law School's Jury Project that was led primarily by Harry Kalven Jr., and Hans Zeisel. The other subseries include files related to Zeisel's work opposing the death penalty; the Law School's arbitration and tax projects; and studies of automobile accidents and court delay. Subseries One: The General Jury Project contains materials related to the jury recordings scandal of 1955. The Project's recording of jury deliberations (with the consent of the court) in Wichita, Kansas became public and resulted in hearings before the United States Senate's Internal Security Sub-Committee. Dean Edward H. Levi testified before the committee under subpoena, but the Committee did not ultimately penalize the Law School or its faculty.

VII. Writings: Includes drafts, research, notes, and reviews related to Zeisel's many published works - such as his books, articles, book reviews, and letters to the editor. It also contains drafts of unpublished writings, including short essays and the third book from the University of Chicago Jury Project, The American Civil Jury, as well as copies of his many speeches, government testimony, and reports.

VIII. Writings by Others: Consists of drafts of writings authored by Zeisel's colleagues, as well as related correspondence and research materials. In particular, this series contains drafts of the German poetry anthology that Zeisel engaged translator Max Knight to assemble, along with their correspondence concerning the project, though the anthology was never ultimately published.

IX. Audiovisual: Contains cassette tapes, VHS tapes, audio and videotape reels, and photographs. These materials generally relate to Zeisel's role as a litigation consultant, but they also include recordings of Zeisel's academic lectures and debates, as well as recordings from the University of Chicago Law School's Jury Project.

X. Oversize: Includes press clippings, computer data printouts, and posters related to a variety of Zeisel's research and teaching interests.

XI. Restricted: Consists of restricted financial, personnel, student, and legal material. Legal files concern the University of Chicago Law School's Jury Project, Zeisel's work as a consultant on death penalty cases, and Zeisel's work as a litigation consultant for commercial companies. Materials in Subseries One are restricted for fifty years from date of record creation and will be fully open in 2042. Materials in Subseries Two-Five are restricted for eighty years from date of record creation. Materials in Subseries Two will be fully open in 2071. Materials in Subseries Three-Five will be fully open in 2072.

Series V: Research

This series is divided into five subseries: Juries; Death Penalty; Other Legal Research; Social Sciences and Statistical Research; and General Research Files. Each subseries is arranged alphabetically, by topic. The first two subseries relate to the two primary areas of Zeisel's legal research, as demonstrated by his involvement in the University of Chicago Law School's Jury Project and his consultant work on capital punishment cases. The files in these subseries include articles, memoranda, notes, and other documents gathered in the course of Zeisel's scholarly research on these subjects. Documents relating to his studies of jury behavior and citizens' views of the death penalty are located in the relevant subseries of Series VI: Projects and Studies. Subseries Three and Four concern broader areas of Zeisel's academic focus and contain articles, correspondence, memoranda, and notes. Subseries Four: Social Science and Statistical Research includes files related to Zeisel's proposed, but never published, book of statistical detective stories, designed to bolster student interest in statistics through mystery stories. Subseries Five includes files that run the breadth of Zeisel's personal interests, including literature, science, and political conditions in Europe and Russia.

Series VI: Projects and Studies

This series contains documents related to Zeisel's many projects related to social science and the law. The bulk of the series concerns the University of Chicago Law School's Jury Project that was led primarily by Harry Kalven Jr., and Hans Zeisel. It is divided into five subseries: General Jury Project; Criminal Jury Project; Civil Jury Project; Death Penalty Projects; and Other Projects. Each subseries is arranged alphabetically, by topic.

The General Jury Project subseries includes documents such as proposals, reports, questionnaires, and research that relate to the Jury Project as a whole. In particular, it contains correspondence, memoranda, and testimony pertaining to the jury recordings scandal of 1955; the project's recording of jury deliberations (with the consent of the court) in Wichita, Kansas became public and resulted in hearings before the United States Senate's Internal Security Sub-Committee. Dean Edward H. Levi testified before the committee under subpoena, but the Committee did not ultimately penalize the Law School or its faculty. Subseries One also includes questionnaire responses from numerous national embassies concerning jury procedures in their countries, as well as files related to the debate over the shrinking size of federal juries in the 1970s and 1980s, a subject on which Zeisel testified before the United States Senate as an expert.

The second and third subseries contain documents related to juries in criminal trials and civil trials, respectively. Subseries Two primarily includes interview forms and resulting summaries from studies of criminal juries in Cook County and New Jersey. Subseries Three includes court transcripts, interview forms, summaries, and coding sheets from studies of civil juries in Cook County, New Jersey, and Minnesota, in addition to studies of split trials, wherein civil trials are divided between sessions that determine fault and those that determine damages.

Subseries Four: Death Penalty contains surveys from a study of jurors' views on the death penalty and life imprisonment without parole, as well as correspondence, memoranda, and court transcripts from cases involving capital punishment.

Subseries Five: Other Projects contains documents from studies on arbitration, taxation policy, automobile accidents, and court delay, among others. Such documents generally include correspondence, project reports and memoranda, and questionnaires.

This series is divided into six subseries: General Writings; Books; Articles; Speeches and Conference Papers; Testimony and Reports; and Criticism. All subseries are arranged chronologically, except for Subseries Two which is arranged alphabetically by book title.

Subseries One contains Zeisel's bibliographies; drafts of his unpublished memoirs; his newspaper columns and letters to the editor; and other small, unpublished pieces concerning a variety of topics.

Subseries Two contains drafts and research related to several of Zeisel's books, including the never-published culmination of the University of Chicago's Civil Jury Project, The American Civil Jury, as well as the posthumously published Prove It With Figures (1997) co-authored with David Kaye.

Subseries Three contains reprints and drafts of Zeisel's scholarly articles, along with related research and correspondence. This subseries also includes Zeisel's April 8, 1961 piece in The Saturday Review entitled “Who are the Guilty?” that concerned the trial of former Nazi officer Adolf Eichmann, along with related correspondence and clippings.

Subseries Four contains drafts, notes, and research concerning Zeisel's many speaking engagements covering a wide range of topics.

Subseries Five contains drafts of Zeisel's testimony regarding criminal law before government committees as well as related memoranda.

Subseries Six contains book reviews and other criticism authored by Zeisel.

Series VIII: Writings by Others

This series includes typescript drafts of writings authored by Zeisel's colleagues, as well as related correspondence and research materials. In particular, this series contains drafts of the German poetry anthology that Zeisel engaged translator Max Knight to assemble, along with their correspondence concerning the project. Zeisel sought to encourage the spread of German poetry in the United States, especially among Americans of German ancestry, and felt an anthology that included both German and English versions of popular German poems would help that endeavor. Ultimately, however, the anthology was never published.

The cassettes and VHS tapes primarily contain recordings related to Zeisel's role as a litigation consultant for various companies facing lawsuits, such as recordings of mock trials. Some cassettes include recordings of Zeisel's academic lectures and debates. The audiotape reels concern the University of Chicago Law School's Jury Project, and the photographs include images of Zeisel and his family members, as well as images used in his consulting work.

Series XI: Restricted

This series contains five subseries: Financial and Personnel Material; Student Material; Legal Correspondence; Death Penalty Cases; and Consulting. Materials in Subseries One are restricted for fifty years from date of record creation. Materials in all other subseries are restricted for eighty years from date of record creation.

Subseries One includes financial material related to grant budgets, primarily concerning the Civil Jury Project, and personnel material such as letters of recommendations for colleagues, research assistant applications, and University of Chicago faculty positions. Subseries One will be fully open in 2042.

Subseries Two contains letters of recommendation for University of Chicago students, graded student material, and applications (including transcripts) for student research assistant positions. Subseries Two will be fully open in 2071.

Subseries Three includes correspondence with counsel, including both Zeisel's personal attorney and counsel engaged by the University of Chicago Law School to advise on the legality Jury Project studies in various courts of law. Subseries Three will be fully open in 2072.

Subseries Four contains correspondence, surveys, and court documents related to capital punishment cases for which Zeisel served as a consultant. Subseries Four will be fully open in 2072.

Subseries Five includes documents related to Zeisel's work as a litigation consultant. He advised companies and their legal counsel on matters concerning trademark infringement and confusion, jury selection, and general survey and sampling techniques. Files generally contain correspondence, consumer surveys and reports, draft court documents, notes, and related research created in preparation for litigation. Zeisel worked with companies such as Ford, McDonald's, MCI, and Exxon. Oversized consulting materials are located at the end of the series. Subseries Five will be fully open in 2072.
